This policy describes Breeze Business Management’s (“Breeze”, “we”, “us”, “our”) privacy and information practices with respect to the personal information that we may collect about you, how we use personal information, and the manner in which personal information may be disclosed or shared by us. “Personal information” means information about an identifiable individual, meaning any information that relates to you and identifies you personally, either alone or in combination with other information.

1.TYPES OF PERSONAL INFORMATION AND PURPOSES OF COLLECTION

Breeze Business Management may collect personal information from you in order to provide our services, which include but are not limited to:

● Bookkeeping services

● Accounting services, including filings with the CRA and payments to suppliers

● Provision of software solutions for business management needs

Breeze Business Management may collect personal information through various methods, including:

Information You Provide to Us: We collect personal information that you voluntarily provide to us through digital forms and through our website when you engage Breeze Business. We may occasionally request from you and you may otherwise voluntarily provide us with personal information through other methods including, but not limited to, feedback and surveys.

Personal information we collect includes but is not limited to:

  • Name

  • Birth date

  • Address

  • Email

  • Phone number

  • Vehicle information

  • Professional membership information

  • Financial information including banking and credit card information, bank deposit information, login information for commercial credit card and commercial banking accounts

  • Business tax account information, including GST/HST account number

  • Payroll account information

  • Commercial insurance information, including account numbers

  • Government account information required for tax filing purposes

Communications: We may receive personal information about you through your use of our services and your correspondence with us by phone, text, and email, including through use of third party platforms that facilitate such communications. When you send email, text, or other communications to us, including through third party service providers, we may retain those communications in order to process your inquiries, respond to your requests and improve our services

Analytics: Our website is hosted by Squarespace. Analytics tools provided by Squarespace allow us to better understand how visitors use our website by providing us with information including visitor IP addresses, the date and time that you visited our site, and which pages you visited. We may retain and use information obtained from Squarespace to improve our services and optimize our website. We also use Google Analytics, which may provide us with visitor behaviour information collected using cookies. Aggregated reports from Google Analytics may include visitor information including IP addresses.

Third Parties: If permitted by applicable laws, we may obtain information about you from third parties, such as business or marketing partners, social media, commercial lead providers, and other data providers and/or publicly available sources. Personal information we obtain from these sources may include your contact information, information concerning your business, or other information pertaining to the nature of your request. If you choose to use third party services, which we may use from time to time in the course of providing services to you, you consent to providing us with direct access to your bank accounts to facilitate our provision of services. Your use of such third party services is subject to their respective privacy policies. You should consult those privacy policies prior to consenting to using their services.

We may collect personal information from you for any of the following purposes:

● To establish and maintain responsible business relations with you

● To communicate with you and respond to your inquiries and/or complaints

● To comply with legal and regulatory requirements

● For other purposes that we may indicate to you from time to time

We identify the purposes for which we collect, use and disclose your personal information. We only collect personal information for purposes that would be considered reasonable in the circumstances and only such information as is required for the purposes of providing our services. We use only fair and lawful methods to collect personal information.

Our use of personal information is limited to the purposes described in this Policy. Breeze Business Management does not otherwise sell, trade, barter, exchange or disclose for consideration any personal information we have obtained.No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

2. CONSENT

Unless an exception to consent applies, Breeze only collects, uses or discloses your personal information with your consent, which may be express or implied as required by applicable law. You may withdraw your consent at any time, subject to legal and contractual restrictions.

By using or accessing our Services, or otherwise signaling your acceptance or interacting with us, you consent to the collection, use, transfer and disclosure of your personal information by Breeze Business Management in accordance with the terms of and for the purposes set out in this Policy, as they may be amended from time to time. Before you provide any personal information, we will request and you must provide your express consent to our collection, use, transfer and disclosure of your personal information as described in this Policy.

Further, if a client provides us with personal information relating to a third party, by signing the consent and acknowledgment, the client represents and warrants that they have provided all required notices and/or obtained appropriate consent from the third party to allow us to collect, use and disclose their personal information for provision of the services.

Otherwise, Breeze Business Management will obtain your express consent (by verbal, written or electronic agreement) to collect, use or disclose your personal information for any new and additional purpose.

At any time, subject to contractual and legal restrictions, you may withdraw or change your consent to our use of your personal information, request us to delete it from our files, or notify us if you do not wish us to use your personal information for any purpose other than for the purposes specifically identified when you provided the personal information to us.

Under certain exceptional circumstances, Breeze Business Management may have a legal duty or right to collect, use or disclose your personal information without your knowledge or consent. In accordance with applicable laws, we will not disclose your personal information without your consent, except where your information is required to be disclosed:

● for the purposes of completing a business transaction, such as a sale of our business, merger, amalgamation or similar transaction;

● for law enforcement purposes;

● for the purpose of complying with a legal requirement;

● where information is public as permitted by law;

● where it is reasonable for the purposes of investigating a breach of an agreement, or actual or suspected illegal activity; or

● where it is necessary to permit us to pursue available remedies or limit any damages that we may sustain

Where required or permitted to disclose personal information without consent, we will not disclose more information than is required.

3. SHARING OF YOUR INFORMATION

Breeze Business Management may disclose your personal information to the following parties:

● Individuals or organizations who act as our advisers or consultants;

● Our employees on a need-to-know basis;

● The following analytics service providers:

o Squarespace: Squarespace allows us to better understand how visitors use our website by providing us with visitor information including visitor IP addresses. We may retain and use information obtained from Squarespace to improve our services and optimize our website.

o Google Analytics: We use Google Analytics on our website. Google Analytics allows us to analyze and enhance how you interact with our website. For more information on how Google Analytics collects and processes information, as well as how you can control the information sent to Google, please review Google’s site “How Google uses data when you use our partners’ sites or apps” located at www.google.com/policies/privacy/partners/. Google Analytics also uses cookies to collect standard internet log information and visitor behaviour information in an anonymous form. The anonymous information generated by Google Analytics cookies about your use of our website (including your IP address) is transmitted to Google and compiled into aggregated statistical reports that are used by Breeze Business Management to optimize website content. You may control your advertising preferences or opt-out of certain Google advertising products (i.e. the Google Analytics cookies) by visiting the Google Ads Preferences Manager, currently available at www.adssettings.google.com

.● Breeze Business Management may disclose any personal information it processes to a third party in the event of a change of ownership of, or a grant of a security interest in, all or part of Breeze Business Management through, for example, as asset or share sale, or some other form of business combination, merger, amalgamation or joint venture, provided that such party is bound by appropriate agreements or obligations and required to use or disclose such personal information in a manner consistent with the use and disclosure provisions in this Policy and applicable law.

● Other service providers, including individuals or organizations who are, or may be, involved in maintaining, reviewing and developing our systems, procedures and infrastructure including testing or upgrading our computer systems, provide email solutions, hosting services, or other systems with whom we sync to-do lists, calendars and process the meaning of user submitted text (i.e. Google services including Gmail; Google sheets, docs, and Drive; Google Calendar; (https://policies.google.com/privacy?hl=en-US).

● If requested by you in writing, Breeze Business Management may disclose your personal information to third parties that provide additional services to you, including accountants, lawyers, or other persons to whom you wish to have your information disclosed.

● Otherwise as permitted by applicable law

Any such disclosure of an individual’s personal information outside of Breeze Business Management is, to the extent possible, made on a confidential basis with the information to be used only for the purpose of which it was disclosed.

4. STORAGE, CROSS-BORDER TRANSFER AND SAFEGUARDING YOUR PERSONAL INFORMATION

Information that we collect is stored on servers using standard physical, technical and organizational security procedures and practices appropriate to the nature of the information in an effort to protect information from unauthorized access, destruction, use, modification, or disclosure.

Certain cloud data is stored in servers managed by Google.

We further protect personal information by restricting access only to those employees that require access to the information in order to provide our services. Please note that confidentiality and security can never be 100% assured when information is transmitted or stored electronically.

We will take reasonable steps, through contractual or other reasonable means, to ensure that a comparable level of personal information protection is implemented by our third party service providers who assist in providing services to you.

Breeze Business Management may transfer personal information to a service provider that is located outside of Canada where privacy laws may differ from those in your jurisdiction. Your personal information may also be subject to access by and disclosure to law enforcement agencies under the applicable foreign legislation.

5. RETENTION OF YOUR INFORMATION

We keep your personal information only as long as necessary to fulfill the purpose for which it was collected and to meet our legal and contractual obligations. The length of time we retain information varies, depending on the purpose for which it was collected and the nature of the information. This period may extend beyond the end of your relationship with us but it will be only for so long as it is necessary for us to have sufficient information to respond to any issues that may arise at a later date.

We will destroy, erase or make anonymous documents or other records containing personal information as soon as it is reasonable to conclude that the original purpose is no longer being served by retention of the information and retention is no longer necessary for legal or business purposes. We will take due care when destroying personal information so as to prevent unauthorized access to the information.

Our website may contain links to third party websites. If you follow any of these links, please note that third party websites have their own privacy policies. We do not accept any responsibility or liability for privacy and data protection practices of third parties. Please check the policies of third parties before you submit any information to external websites.


7. MANAGING YOUR INFORMATION

Access. Breeze Business Management permits the reasonable right of access to your personal information. Upon written request and authentication of identity, we will provide you with access to your personal information under our control, subject to any legal requirements and applicable exceptions to the right of access. Where an access request is refused, we will notify you in writing and provide our rationale for refusal along with a list of next steps available to you.

Correction. If you demonstrate the inaccuracy or incompleteness of personal information, we will amend the information as required. If appropriate, we will send the amended information to third party service providers to whom the information has been disclosed.

Opt-out from Secondary Marketing. You may opt-out of our use of your personal information for marketing purposes at any time by contacting us. You may also opt out of email or text based marketing by using the unsubscribe feature.

Withdrawal of Consent to Further Use and Disclosure. You may withdraw your consent to our further use and disclosure of your personal information, subject to legal and contractual restrictions. If you withdraw your consent, this may prevent us from providing certain services to you, which we will explain at the time of withdrawal.


8.UPDATES TO THIS PRIVACY POLICY

The current version of this privacy policy will apply each time you use our website, products or services. We reserve the right to update this privacy policy from time to time. If we modify our privacy policy and make changes, we will revise the “Last Updated” date stated at the end of this document and make note of any material revisions. If we make material changes to our privacy policy, we may also notify you by other means, such as by sending you an email notification. By continuing to use our products and services after such changes are in effect, you accept and agree to the changes.
